Plank Law Firm brought a mandamus complaint against the City of Delaware, Ohio on behalf of the firm’s clients asking the Delaware County Common Pleas Court to order the City of Delaware to commence appropriation proceedings to compensate the clients for damage caused by methane gas that had migrated onto their property from a City landfill located on City property.  Plank Law Firm’s clients prevailed in the mandamus action and the Court ordered the City of Delaware to file a petition for the appropriation of property in accordance with Ohio Revised Code Sections 163.01 et seq. By the judgment of the Court in the appropriation case, the firm’s clients were awarded compensation for the damage to their property and attorneys’ fees.
